THIS AGREEMENT FOR ARTICULATION BETWEEN
UNIVERSITY OF CANBERRA (ABN 81 633 873 422), a body corporate established by the University of Canberra Act 1989 of the Australian Capital Territory having its campus located at University Drive, Bruce in the Australian Capital Territory Australia; (“UC”)
AND
THAKUR COLLEGE OF SCIENCE AND COMMERCE, established in 1992, Affiliated to the University of Mumbai and having its campus at Thakur Village,Kandivali (E), Mumbai - 400 101 (“TCSC”)
Objectives
- To obtain a UC Degree via the articulation arrangements set out in this Agreement, students must undertake an agreed number of units of study, across two academic sessions per year at UC, in addition to their previous studies at TCSC.
- Students will initially be enrolled as TCSC students and conduct their studies of the TCSC Units within a specified timeframe. In the second stage of the program, successful applicants will be enrolled as UC students and complete their study at UC, generally within two (2) years in order to receive a UC Degree.
- TCSC students will receive credit points, as per the attached the Schedules, for their study of the applicable TCSC Units. This credit will be allocated against their study for the UC Course as set out in the applicable Schedule. Students need to successfully complete the remaining credits at UC to be awarded the designated UC Degree. Detailed articulation arrangements are contained in the Schedules (attached).
Academic Requirements And Degree Awarded
TCSC Phase
- In order to access the articulation arrangements set out in this Agreement, a TCSC student must have successfully completed the TCSC Units in accordance with the academic requirements and policies of TCSC, including achieving the marks required under relevant regulations (as reported on the student's official academic record from TCSC). TCSC must provide testamurs and transcripts to each such student in order for the student to demonstrate to UC his or her successful completion of the TCSC Units.
- In order to access the articulation arrangements set out in this Agreement, a TCSC student must also meet the English language requirements set out in clause 5.
- TCSC must provide students with reasonable assistance to apply for admission into a UC Course pursuant to this Agreement.
UC Phase
- In order to access the articulation arrangements set out in this Agreement, a TCSC student must apply for admission into a UC Course either: 1. during his or her last semester studying the TCSC Units at TCSC; or 2. within the two year period after completion of the TCSC Units at TCSC.
- If a TCSC student applies for admission into a UC Course under clause 4.2.1(a) : (i) the student must provide to UC a copy of their current transcript showing the Units they have completed at the time of application; and (ii) once the student has completed their last semester studying the TCSC Units at TCSC, TCSC agrees to send an updated transcript for the student showing that the student has complied with the requirements of clause 4.1.1.
- UC will consider an application by a TCSC student for admission to a UC Course if the student has met the requirements of clauses 4.1, 4.2.1 and 4.2.2, and if the student has met all other applicable UC Admission Requirements.
- If a student is admitted into the UC Course, he or she will be granted advanced standing by UC equivalent to the UC credit points contained within the applicable Schedule for the applicable UC Course.
- A student must successfully complete the remaining credit points of study at UC, as set out in the applicable Schedule, in accordance with all applicable UC rules and policies that apply to the student (including in relation to academic progress and student conduct) before being awarded the applicable UC Degree.
English Requirements For UC
- Students must attain an IELTS (Academic) level of 6.0 overall with minimum 5.5 across all bands to qualify for direct entry into a UC Course, as determined pursuant to UC's Admission Procedures for Undergraduate and Postgraduate Coursework Courses (as amended or replaced from time to time).
- Where a student is assessed at being below an IELTS (Academic) level of 6.0 overall with minimum 5.5 across all bands, the following pathways will be required.
- Students must attain at least an IELTS (Academic) level of 6.0 overall with minimum 5.5 across all bands to qualify for direct entry into a UC Course as outlined in the Schedules.
- Students with an IELTS of 6.0 overall with at least one component(s) below 5.5 or with an IELTS of 5.5 overall are required to complete 10 weeks of ELICOS (English Language Intensive Courses for Overseas Students) at the University of Canberra English Language Institute and assessed from that course as having attained a standard equivalent to IELTS 6.0 overall with minimum 5.5 across all bands before starting their program in a UC Course as outlined in the Schedules.
- Students with an IELTS of 5.0 overall are required to complete 20 weeks of ELICOS at the University of Canberra English Language Institute and assessed from that course as having attained a standard equivalent to IELTS 6.0 overall with minimum 5.5 across all bands before starting their program in a UC Course as outlined in the Schedules.
Credit Exemption
- UC has evaluated the TCSC Units and agrees to recognise the validity of TCSC Units successfully completed by students and to honour the credit exemption of these units to the applicable UC Course during the term of this Agreement.
- All articulation arrangements set out in the Schedules attached may require further revision during the term of this Agreement due to changes in requirements of the government regulator, Tertiary Education Quality Standards Agency (TEQSA), or other changes in law or UC policies. UC will notify TCSC of any such revisions to the articulation arrangements.
- If TCSC wishes to change any of the content, structure or delivery of any TCSC Units, including to maintain its relevance and currency, it must promptly provide UC with the amended unit descriptions, unit outlines, course design and learning and assessment strategies. UC will assess the proposed changes for equivalence and appropriateness (including in light of all factors that UC is required to take into account under applicable laws and UC rules, policies and procedures), and notify TCSC whether or not the changes are acceptable. The articulation arrangements set out in this Agreement will only apply in respect of students who undertake or have undertaken TCSC Units in the form approved by UC.
- If UC wishes to change the UC Units or any other aspect of the design of a UC Course, it must notify TCSC of any changes to the articulation arrangements set out in the Schedules.
Duties And Obligations
- Each of TCSC and UC shall comply with their respective duties and obligations as set out in Appendix 1 to this Agreement.
- TCSC acknowledges that it will be UC's 'agent' (as that term is defined in, and for the purposes of, the Education Services for Overseas Students Act 2000 (Cth)) and must comply with the obligations set out in Appendix 2 and all other reasonable and lawful requirements of UC in relation to its role as agent in order to facilitate UC complying with its obligations under the ESOS Act.
- All marketing and promotional material produced or used by or on behalf of TCSC in relation to the UC Courses or the articulation arrangements under this Agreement, and any other materials on which TCSC uses any of UC’s trade marks pursuant to clause 7.7, must be approved in writing by UC’s Marketing and International Office prior to distribution or publication.
- UC may, at any time during the term of this Agreement or within twelve months of the expiry or termination of this Agreement, on giving seven days prior notice to TCSC, carry out a review of TCSC's performance of its obligations under clauses 7.2 and 7.3, including reviewing the books and records of TCSC. TCSC must cooperate with UC concerning any such review, including by providing access to and copies of documents and information relevant to the performance of its obligations.
- TCSC acknowledges and agrees that UC will make publicly available information about the articulation arrangements established under this Agreement pursuant to its rules and policies from time to time.
- TCSC must provide current, accurate, adequate, and openly accessible information to prospective and enrolled students about the articulation arrangements established under this Agreement.
- UC grants TCSC a non exclusive licence to use any trade marks of UC notified by UC from time to time, for the term of this Agreement, for the sole purpose of TCSC marketing and promoting the articulation arrangement and complying with its obligation under clause 7.6. TCSC must: (i) observe all directions notified to it by UC regarding the representation of UC's trade marks on any materials and the manner in which the trade marks are used; (ii) not use any of UC's trade marks in any way which is likely to harm or prejudice UC's rights in the trademarks; (iii) not use any of UC's trade marks in any way that is misleading or deceptive or likely to be misleading or deceptive, or for any unlawful purpose; (iv) not apply to register anywhere any trade mark, or apply to register or use any business name, company name or internet domain name that comprises or contains any of UC's trade marks, or any words or images that are substantially identical with, or deceptively similar to, any of UC's trademarks, without the prior written consent of UC; and (v) cease using any trade mark on termination or expiry of this Agreement, or if otherwise notified in writing by UC.
UC Awards
All UC awards are accredited by the University of Canberra, prescribed under its statutes, audited by the Tertiary Education Quality Standards Agency (TEQSA) and registered with the Commonwealth Register of Institutions and Courses of Study for Overseas Students (CRICOS). The University of Canberra is registered with CRICOS and carries the provider number #00212K.
